Terms of Service

These Terms of Service ("Terms") are an agreement between you and Heluva Global Media LLC ("GoTaller," "we," "us"), 1001 S. Main St. #600, Kalispell, MT 59901, United States. They govern your use of the GoTaller mobile app and the gotaller.app website (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use GoTaller. If you are under 18, you may use the Service only with the knowledge of a parent or legal guardian, and a parent or guardian must approve any purchase.

2. What GoTaller is

GoTaller estimates your adult height from information you provide (age, biological sex, current height, parent heights, and lifestyle answers) and builds a daily plan of sleep, nutrition, posture, and activity habits, with tools to check in daily and log your height over time.

Medical disclaimer. GoTaller's height predictions are statistical estimates for guidance only — produced by growth-model calculations, not by medical examination. GoTaller is not a medical device and does not provide medical advice, diagnosis, or treatment. Individual growth varies widely, and no specific height outcome is promised or guaranteed. Healthy habits support your body's natural growth potential; they do not create growth beyond it. Always consult a doctor or qualified health provider with questions about your or your child's growth, and never disregard professional medical advice because of something in the app. If you have a medical concern, contact a healthcare professional.

3. Accounts

Installing the app creates an anonymous account so your data can sync. You may optionally sign in with Google to keep your data across devices. You're responsible for keeping access to your device and Google account secure. You may delete your account at any time — see Delete account.

4. Subscriptions and purchases

Plans. GoTaller Pro is offered as a weekly subscription ($5.99/week), a yearly subscription ($24.99/year, currently with a 3-day free trial), and a one-time lifetime purchase ($34.99). Promotional prices may be offered from time to time. The price shown in the app at the moment of purchase is the price that applies.
Billing. On Android, payments are processed by Google Play under your Google Play account. On iPhone, payments are processed by Apple's App Store under your Apple account. We do not collect or store payment details.
Free trial. If your plan includes a free trial, you will be charged automatically when the trial ends unless you cancel at least 24 hours before it ends. Trial eligibility is determined by Google Play (generally one trial per Google account).
Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled. Cancel any time in Google Play → Payments & subscriptions → Subscriptions (on iPhone: Settings → your name → Subscriptions). Cancelling stops future renewals; you keep access until the end of the paid period.
Refunds. Refunds are handled by the store you purchased through — Google Play's refund policy on Android, or Apple's App Store refund process (reportaproblem.apple.com) on iPhone. For help, contact support@gotaller.app.
Price changes. If we change subscription prices, the change applies to renewals only after notice through Google Play, and you can cancel before it takes effect.

5. Acceptable use

You agree not to misuse the Service — including attempting to break, probe, or overload our systems, accessing other users' data, reverse-engineering the app except where the law permits, or using the Service for anything unlawful.

6. Intellectual property

The Service — including the app, site, design, text, exercise videos, recipes, and branding — belongs to Heluva Global Media LLC or its licensors and is protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable license to use the app for your own personal, non-commercial use. The data you enter remains yours.

7. Third-party services

The Service relies on third-party services — including Google Play, Google Sign-In, Supabase, RevenueCat, and content delivery networks — which have their own terms and policies. We are not responsible for third-party services.

8. Disclaimer of warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that estimates will match your actual adult height, or that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Heluva Global Media LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim (or $50 if you paid nothing). Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Heluva Global Media LLC from claims arising out of your misuse of the Service or violation of these Terms.

11. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination (including 6, 8, 9, 10, 12, and 13) survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us at support@gotaller.app and give us 30 days to try to resolve the issue informally. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Montana, and you consent to their jurisdiction.

13. Additional terms for the Apple App Store

If you downloaded GoTaller from Apple's App Store, the following also applies:

These Terms are between you and Heluva Global Media LLC only — not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
Your license is limited to use of the app on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service (except that the app may be accessed by other accounts via Family Sharing or volume purchasing).
Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app; any other warranty claims are our responsibility as set out in these Terms.
Apple is not responsible for addressing any claims by you or a third party relating to the app or your use of it — including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar legislation.
If a third party claims the app infringes their intellectual-property rights, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of that claim.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll update the date above and notify you in the app before they take effect. Continuing to use the Service after changes take effect means you accept them.
